User guide for procurement of plant and works (design-build) - FIDIC Yellow Book (2017) using merit point criteria
This publication provides guidance for borrowers on how to prepare a bidding document for a single-responsibility lumpsum type of Plant and Works (Design-Build) contract using FIDIC Yellow Book (2017) general terms and conditions. Borrower can use this document for procurement of Electrical and Mechanical Plant, and for Building and Engineering Works, designed by the Contractor.
It also covers how to evaluate bids and award contracts, based on the Asian Development Bank’s Standard Bidding Document for the Procurement of Plant and Works (Design-Build) for cases “with” and “without” prequalification. The evaluation approach in this user guide is based on merit point criteria (MPC) that take into account both technical and financial scores of the proposals. Use of MPC allows Borrowers to consider non-price factors in the assessment of bidders’ qualification and responsiveness of the bids such as quality, sustainability and innovation, to deliver value for money.
For the transaction published after 1 January 2025, ADB requires its Borrowers to use merit point criteria for all transactions whose invitation for bids will be advertised internationally using ADB standard Bidding documents. Use of an approach other than MPC should be justified through strategic procurement planning and approved on a case-by-case basis.
