On the apparent failure of patents: a response to Bessen and Meurer

A response to James Bessen and Michael Meurer's article on the patent system is presented. If the value gained from owning patents exceeded the value destroyed by allegations of infringement, Bessen and Meurer inferred that the focal firm reaped "net benefits" from patents, thus enticing the firm to invest more in research and development. There are many things to like about Bessen and Meurer's study. Refreshingly, the authors allowed firms to play dual roles as patent owners and potential defendants in lawsuits filed by others. Legislative efforts to reform aspects of the US patent system, including the process for challenging the validity of rights and methods for calculating damages in infringement suits, will likely resume after the 2008 presidential election. There are several ways in which public firms reap indirect benefits from the patent system. One is through information revealed during the patenting process..Printed journal
